1. Scope and Acceptance
These Terms of Service govern your use of Deutsch mit Suliman (the "Site"). By accessing or using the Site, creating an account, or enrolling in any course, you agree to these Terms and our Privacy Policy, including provisions on public feature visibility and live-session recordings. If you do not agree, do not use the Site.
2. Provider and Contact
The Site is operated by DMS GmbH (address above). Contact and support options are available on the Site and are the primary channel for legal and service-related communication.
3. Eligibility and Account Registration
You must provide accurate, complete, and current information when creating an account and keep your credentials confidential. You are responsible for all activity under your account. We may require identity, ownership, or abuse-prevention checks where needed.
4. Educational Services
The Site provides German-learning services, including courses, vocabulary, listening tools, writing and proofreading tools, text-to-speech, statistics, and optional community features. Some services are paid, restricted by plan, quota, or course enrollment.
5. Acceptable Use
You agree not to misuse the Site. In particular, you must not share or resell account access, bypass technical or payment controls, scrape or automate extraction of protected content, upload unlawful or abusive content, infringe intellectual property rights, or interfere with service stability.
6. Device and Access Controls
We may enforce account/device restrictions and related anti-abuse controls. Access to specific resources (including private/premium media) may depend on account status, device status, role, enrollment, and feature entitlement.
7. Payments, Subscriptions, and Renewals
Paid products, plans, and course access are subject to pricing and billing terms shown at checkout or in your account. Refund and withdrawal rights depend on what you buy: for physical goods (for example books), statutory consumer rights apply as described on our withdrawal page. For digital content (online courses, downloads, streams, practice access), the statutory rules for digital services apply, including the early-start consent you give at checkout where required; after performance has begun in line with that consent, statutory withdrawal may be excluded as permitted by law. Any renewal, upgrade, downgrade, cancellation, and expiration effects are governed by the product terms shown at purchase time.
8. User Content and Community Areas
You retain rights to content you submit where applicable, but grant us the rights necessary to host, process, and display that content to operate the service. We may moderate, limit, or remove content that violates law, these Terms, or safety policies.
9. Leaderboards and Public Visibility
Where enabled, course challenge boards or similar pages may display account identifiers (such as your display name) and learning-related rankings. By using these features, you acknowledge and agree that related profile/score information may be visible to other users or visitors as configured by the service.
10. Live Sessions and Recordings
Some courses may include live sessions (for example live classes, workshops, or Q&A events) that can be recorded, including participant voice, image, screen contributions, chat submissions, and other session interactions. By enrolling in a course that includes live sessions, you provide explicit agreement that your participation may be recorded and included in such recordings.
You grant us the right to store, edit, reproduce, distribute, publicly present, and commercially reuse these recordings for operating and improving the service, quality assurance, staff training, educational reuse, and offering recorded lessons or course packages (including paid resale), unless mandatory law requires otherwise.
11. Intellectual Property
All platform content, software, branding, and course materials are protected by applicable intellectual property laws. Except for limited personal-learning use, no reproduction, redistribution, public display, or derivative use is allowed without written permission.
12. Third-Party Services
Some features rely on third-party providers (for example payment gateways, content hosting, analytics, or language tools). Their services are governed by their own terms and policies.
13. Availability and Changes
We may modify, suspend, or discontinue any part of the Site at any time, including features, plans, eligibility, and technical requirements. We do not guarantee uninterrupted or error-free operation.
14. Suspension and Termination
We may suspend or terminate access immediately if we reasonably believe there is a breach of these Terms, a legal risk, fraud/abuse risk, or a threat to users or the platform. You may stop using the Site at any time.
15. Warranties and Liability
To the maximum extent permitted by law, the Site is provided "as is" and "as available". We disclaim implied warranties where legally permitted. We are not liable for indirect, incidental, special, or consequential damages. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
16. Governing Law and Venue
These Terms are governed by the laws of the Federal Republic of Germany, without prejudice to mandatory consumer protections under applicable EU law. If you are a merchant, legal entity under public law, or special fund under public law, exclusive venue is our registered place of business in Germany.
17. Updates to These Terms
We may update these Terms from time to time. Material changes will be published on this page and, where required, otherwise communicated. Continued use after the effective date means acceptance of the updated Terms.
